This Privacy Policy explains how Hoobio, Inc. (“Hoobio” or “Company”) collects, shares, protects, and uses information when you use our mobile application and any related websites, applications, and platforms where this Privacy Policy is posted (collectively, the “Services”). Please read this Privacy Policy carefully. By using our Services, you acknowledge you have read and understand the terms of this Privacy Policy and our separate Terms of Service. If you do not agree, you may not use or access the Services. Terms not defined in this Privacy Policy will have the same meaning in our Terms of Service.

This Privacy Policy only applies to the Services, and not to websites, applications, or platforms of third parties (collectively, “Third-Party Platforms”), even if such Third-Party Platforms are linked to or accessible from the Services. Each Third-Party Platform will have its own data collection and usage practices and may use their own cookies, web beacons, and other technology to collect information from you. Company is not responsible for the content or practices of any Third-Party Platforms. We are not responsible for the content or practices of any Third-Party Platforms and, if you choose to visit or use them, including if you purchase third-party goods or services or click to be redirected to third-party websites, you do so at your own risk.

Hoobio provides a platform that offers features including, the ability to search for and book Travel Deals and tickets for Events. The Services also allow individuals and Merchants to create and post content (“Content”), including Free Offers and Deals and What’s New, viewable by other users and the public. Users should not post any Content that is private. Hoobio is not responsible for Content.

  1. How do we collect and use information?

Information,” as used in this Privacy Policy, means personal information that can be used to identify, locate, describe, or contact an individual, or as otherwise defined by applicable laws. We may collect information from or about you in a number of ways. Please note that if you decline to provide any of the requested information (whether or not required), you may not be able to take full advantage of the Services and their features or make a purchase from us.

We collect all of this information for our business purposes, namely, to provide and improve our products and services, such as our mobile app and website. Part of this includes compliance with applicable laws, such as responding to legal requests, enforcing this Privacy Policy, our rights, and our Service, and protecting others. We may also use information for short-term, transient use for an interaction with you and to personalize your experience and communications. We use information for security purposes and to protect against harmful activity. Further, we may use information for debugging for functionality, auditing interactions, and internal research. Moreover, we may use information as otherwise instructed by you and with your consent.

In addition, we collect information for commercial purposes, meaning to market our goods and the Services. For example, we collect device and other data to better target advertisements and other content in an effort to create a more personally relevant experience.

We use information for the same reasons that we collect it. For example, we use information for business purposes, such as running our app and website and sending you products that you order, as well as commercial purposes, such as advertising to you after you leave our website.

More specifically, we collect the following information for the referenced purposes, as outlined below.

  • Information You Provide. We collect information from you and about you and your transactions and other interactions with us. This may include when you use the Services, including as part of registering a user account, posting Content, making a purchase, or sign up for our email list. For example, individual users may be asked to provide a user ID, password, first and last name, email address, birth date, gender, address, phone number, and profile picture; and business users may be asked to also provide a business name, URL/website, contact name. Some of this information may constitute identifiers, such as your name, and/or protected class information, such as your gender and age. For certain features, you may also grant us access to your camera roll, such as to upload videos and photos. Further, the Services allow for non-public messages to other users, which may be stored and processed by Company and will be accessible to recipients of the messages. If you use the Services to book your travel accommodations (e.g., flights or hotel rooms), we may need to collect information including your name (and travel partner(s) name(s)), age, email address, driver’s license or passport information, telephone number, and credit card information.

  • Content You Make Public. We collect information from you that you voluntarily post to the Services for public display, such as your Content, which may include posts, comments, photos, videos, text, deals, events, free offers, information about what’s new, and hashtags. Once you make information public, neither you nor Company can control how it may be copied, shared, or used by third parties, even if you and/or Company later delete such information, so carefully consider what information you choose to make public.

  • Transaction and Payment Information. We collect information from you as needed to process payments for deals you purchase or use, or other products or services that you buy, or as provided by you to administer your participation in services, programs, and offers, such as your payment card number, expiration date, and card verification number.   • Commercial Information. We may collect information relating to the interests and activities of users, including relating to travel preferences, purchasing tendencies and order history, and information about friends who refer you or whom you have referred.

  • Device/Internet Connection Information. When you use the Services, we automatically gather information made available by your device, web browser, and internet service provider, depending on your settings for each. For example, we may collect information about your hardware and software, namely, your device model, operating system version, device memory, advertising identifiers, unique application identifiers, apps installed, unique device identifiers, browser type, language, battery level, and time zone. We may also collect information related to any social media accounts that you link to the Services and from any of Company’s partners that integrate with the Services through API.   • Internet Activity Information. When you interact with the Services, we may collect information about your server logs, access dates and times, operating system, browser type, IP address, languages, clicks, views, engagements, search terms, or pages viewed, time spent on pages, browsing history, search history, and information regarding your interaction with a particular website, application, or advertisement, including the Services.

  • Protected Class and Sensitive Information. Due to the specific nature of our Services, you may be asked to provide information about your race, ethnicity, nationality, gender, age, marital or family status, or citizenship or information related to your passport or identification, and any other information, if needed to book travel deals.  

  • Location Information. We collect information about where you are located, both generally and at the time you access the Services, such as your state/province, city, or neighborhood, and, if you agree, more specific location information that is provided through the GPS functionality on mobile or other devices used to access the Services.

  • Other Information. From time to time, we may collect other information from you, such as when you make a claim for a prize pursuant to a contest or other promotion, when you request assistance through our customer service department, or when you voluntarily subscribe to promotions, reminders, or newsletters.

  • Inference Information. We may also create new information about you by drawing inferences from the information identified in the categories listed above, such as a profile reflecting your preferences or trends.

Company gathers information about you through the following sources and means:

  • When You Provide Information Through the Services. Company collects information when users voluntarily enter or upload it while using the Services, including when you post a deal, upload your Content, make a purchase, create an account, sign up for emails, or save account or payment preferences.

  • Through Your Communications. Company may collect information from you outside of your use of the Services, such as if you email us (or respond to a communication) or communicate with us over social media. Information collected outside your use of the Services may be combined with information collected through your use of the Services.

  • When You Use the Services; Through Cookies, Tracking Tools, and Automated Technologies. We may use various technologies to collect and store information when you use, access, or interact with the Services. This may include using Cookies or similar technologies to identify your browser or device. We may collect information from or about your phone(s), computer(s), or other device(s) when you access the Services including the operating system, hardware version, device settings, device identifiers, language and time zone, mobile phone number, IP address, and server logs. Also, third parties may place cookies and pixels on our app or website, and these companies may use that data to show you more relevant advertisements and promotions.   1. Do we sell or share your information to others?

We only sell or share data as outlined in this Privacy Policy. As outlined above, Company uses cookies and other tracking tools, including those placed by, and where information is shared with, third parties. The primary purpose of this practice is to deliver personalized advertisements that are specific to your interests and to avoid displaying repetitive or irrelevant advertisements to you. Company participates in targeted ads, also called interest-based or online behavioral advertising, which may include cross-context behavioral advertising; and we may also sell or share consumer data, including contact information (e.g., so that a provider may contact you about products or services that you may be interested in) and other data (e.g., which may be used for retargeting ads or analytics). Under some privacy legislation, this may constitute “selling” or “sharing” of personal information, such as for business purposes (e.g., providing our Service) and commercial purposes (e.g., other marketing).   1. How do we protect and transfer information?

Company employs technical, administrative, and physical security measures that are designed to protect against the loss, misuse, and alteration of the information under our control. However, no system can be completely secure. Therefore, although we take steps to secure your information, we cannot promise, and you should not expect, that your personal and commercial information, or other communications, will always remain secure. The safety and security of your information also depends on you. Never share your login credentials or password with anyone else and notify us as soon as possible if you believe your account security has been breached.

  1. How long do we keep your information?

Company will retain your information for the length of time necessary to fulfill the Business Purposes and Commercial Purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law or valid court order. We may also delete your information, Content, or account should it violate our Terms or Service or any applicable terms or policies.

  1. Do we transfer your information to a different country?

If you use the Services from a location outside of the United States, your connection will be through and to servers located in the United States, and all information you provide will be processed and maintained in web servers and internal systems located within the United States. By using the Services, you authorize and consent to the transfer of information to the United States and its storage and use as specified above when you provide such information to us.

In certain instances, Company may be required to transfer the information we collect from you and store it in other countries. Some of the recipients of your personal data will be located or have relevant operations outside of your country and the European Economic Area (“EEA”), where the data protection laws may provide a different level of protection compared to the laws in your jurisdiction and with regard to which an adequacy decision by the European Commission does not exist. We will take all necessary measures to ensure that transfers out of the EEA are adequately protected as required by applicable data protection laws. For recipients located outside of the EEA, some are located in countries with adequacy decisions pursuant to Art. 45 GDPR. In each case, the transfer is thereby recognized as providing an adequate level of data protection from a European data protection law perspective. We value consumer privacy rights and strive to provide flexibility with how your personal data is used and shared. If you want to make a privacy request or have any questions, please contact us through our Contact Form or email privacy@hoobio.com with your name and email address or other identifier used in connection with our Services so that we can verify your request. If an authorized agent is making a request on your behalf, the agent should provide its name and contact information, such as an email address, in addition to your information. There may be situations where we cannot grant your request, for example if you make a request and we cannot verify your identity, or if you request deletion of data but we have a legal obligation to keep your personal information. Where we deny your request in whole or in part, we will take steps to inform you of the denial and provide an explanation of our actions and the reasons for the denial.

Applicable privacy laws have different requirements and depend various factors, such as where you live and how much revenue or data is at issue. Generally, we adhere to the following set of privacy rights to the extent applicable and subject to any limitations authorized by law.

  • Access and Correction: You have the right to access and correct information.

  • Disclosure: You have the right to request that we disclose the following to you: the categories of information we have collected about you; the categories of sources from which the information is collected; the business or commercial purpose for collecting the information; the categories of third parties with whom we share the information; and the specific pieces of information that we have collected about you.

  • Limit: You can limit the processing of your data, in particular any sensitive data, and limit the use of automated decision making, such as profiling.   • Opt-Out: You have the right to opt-out of certain data practices. For example, you can unsubscribe from marketing communications by following the opt-out instructions in each message or by contacting us as outlined in this Privacy Policy (please note that we may still send non-marketing messages, and that consent to receiving marketing communications is not mandatory to use the Service).   • Deletion: You have the right to request deletion of your information, subject to applicable laws. Please note that if you share information with other users or post it publicly, we will not be able to delete such third-party access to your information.

  • Objections: You have the right to object, on grounds relating to your particular situation, regarding the processing of your information. If your information is processed for direct marketing purposes, you have the right to object to the processing of information for such marketing, which includes profiling to the extent that it is related to such direct marketing.

  • Withdraw Consent: If you have declared your consent for any information processing activities, and you can withdraw this consent at any time with future effect. Such a withdrawal will not affect the lawfulness of the processing prior to the consent withdrawal.

  • No Discrimination: We will not discriminate against you for making a privacy request or asserting privacy rights.

  • Complaints: You may lodge a complaint with a competent supervisory authority.

  • Specific State Laws: Several states have enacted privacy laws that may apply to you, depending on the circumstances. For example, the California Consumer Privacy Act (“CCPA”), updated by the California Privacy Rights Act (“CPRA”), governs certain California-related conduct. Under California’s “Shine the Light” law, California residents may also request certain information regarding our sharing personal information with third parties for their direct marketing purposes. Further, if you are a California resident under the age of 18, California Business & Professions Code Section 22581 permits you to request and obtain removal of content you have publicly posted. Please note that such a request does not ensure complete removal of public content.

  • International and Other Laws: Depending on where you live, you may have the right to access your own information that we hold; to ask that your information be corrected, updated, or erased; and the right to object to, or request that we restrict, certain processing of your information. Our legal basis for collecting and using your personal data is your consent, the fulfillment of our obligations pursuant to the contract created between you and us, or where the collection and use is in our legitimate interests and does not violate your data protection interests or fundamental rights. You may withdraw your consent to our collection and use of your personal data. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your information used in reliance on lawful processing grounds other than consent. This Privacy Policy only addresses the use and disclosure of information by Company through your interaction with the Services. Third-Party Platforms that may be accessible through links from our Services have their own privacy policies and information collection, use, and disclosure practices. Third-party sellers, advertisers, and partners also have their own privacy practices. We encourage you to familiarize yourself with the privacy statements provided by these third parties prior to providing them with information or taking advantage of a third-party offer or promotion.

  1. How do we protect the privacy of children?

Company does not knowingly collect any personal information about children under the age of 13. If we obtain actual knowledge that we have collected information about a child under the age of 13, that information will be immediately deleted from our database. Because we do not collect such information, we have no such information to use or to disclose to third parties. We have designed this policy in order to comply with the Children’s Online Privacy Protection Act (COPPA).
